Some Thoughts On “Steven Malanga: The Showdown Over Public Union Power”

The governors of states do not necessarily have the same powers as the President. The PATCO maneuver was legal advice forum under emergency statutes; it is not clear that Wisconsin has any similar legal framework to allow the governor there to do the same.

Still, I would applaud if they could find a legal way to do this. Violation of contract is the obvious one. Who enforces the contract, and whether they could be convinced to go along – that’s the key.

As for the errant state legislators, the governor DOES have the power to find them in contempt, and has threatened to do that. They would then be subject to arrest. I think this is more likely to succeed, frankly.
